Terms of Service

These Terms govern the use of the Barel platform and define the rights and obligations between Devop SAS and its users.

1. Purpose

These Terms of Service (hereinafter "Terms") set out the conditions of use of the Barel platform (hereinafter the "Platform" or "Service"), available at barel.app, published by Devop SAS.

Accessing and using the Service implies full and unconditional acceptance of these Terms by the User.

2. Definitions

  • Publisher: Devop SAS, the company that operates the Service;
  • User: any natural or legal person who creates an account on the Platform;
  • Account: the secure personal area allowing the User to access the Service;
  • Subscription: the paid plan granting access to the Platform's features;
  • Content: all data, messages, files, prospects and information processed via the Platform.

3. Acceptance of Terms

By creating an account on the Platform, the User acknowledges having read, understood and unreservedly accepted these Terms. Acceptance is materialized by checking the dedicated box during sign-up.

If the User does not accept the Terms, they may not use the Service.

4. Service description

Barel is a SaaS platform for AI-powered LinkedIn prospecting automation. The Service notably allows:

  • Importing and managing prospects from Sales Navigator, CSV file or LinkedIn search;
  • Automated sending of personalized LinkedIn messages and invitations;
  • Managing a conversational Inbox driven by AI (Voice Cloning);
  • Lead tracking, scoring and automatic qualification;
  • Integration with third-party tools (Calendly, CRM, etc.).

The Publisher reserves the right to evolve the Service's features at any time.

5. Account creation

Sign-up requires creating an account. The User undertakes to provide accurate, complete and up-to-date information. Each account is strictly personal.

The User is solely responsible for the confidentiality of their credentials and any actions performed from their account. Any fraudulent use must be reported immediately to the Publisher.

6. Subscription & payment

Access to the Service requires a paid Subscription, with prices listed on the Pricing page.

6.1 Payment terms

Payment is made by credit card via our secure payment provider (Stripe). The User authorizes the Publisher to automatically charge the Subscription amount at each billing cycle.

6.2 Renewal

The Subscription renews automatically at term for an identical duration, unless the User cancels before the renewal date.

6.3 Price changes

The Publisher reserves the right to change its prices. Any change will be communicated to the User at least 30 days before it takes effect.

7. Trial period

A free trial period of 7 days is offered to every new User. At the end of this period, the Subscription is billed according to the chosen plan, unless cancelled beforehand.

No credit card is required to join the beta.

8. Termination

8.1 Termination by the User

The User may cancel their Subscription at any time from their account, without fees and without notice. Cancellation takes effect at the end of the current billing period; no pro-rata refund is due.

8.2 Termination by the Publisher

The Publisher may suspend or terminate a User's account in case of breach of these Terms, including fraudulent, abusive or unlawful use.

9. User obligations

The User undertakes to:

  • Use the Service in accordance with its purpose and applicable law;
  • Not infringe the rights of third parties, including intellectual property rights;
  • Not send unlawful, defamatory, insulting, racist or otherwise offensive content;
  • Comply with LinkedIn's Terms of Use and the limits set by that platform;
  • Not attempt to circumvent the Service's security measures;
  • Comply with GDPR when processing prospects' personal data.

10. LinkedIn compliance

Barel is an independent third-party tool and is not affiliated with LinkedIn Corporation. The User acknowledges that:

  • Use of Barel must comply with LinkedIn's Terms of Use;
  • The Publisher applies dynamic limits (Smart Limits) to minimize the risk of LinkedIn account restrictions;
  • The Publisher cannot be held liable for any suspension or restriction of the User's LinkedIn account by LinkedIn Corporation.

11. Intellectual property

All elements of the Platform (code, design, brands, logos, texts) are the exclusive property of Devop SAS. The User benefits from a personal, non-exclusive and non-transferable right of use, limited to the duration of the Subscription.

Content created by the User (messages, prospect lists) remains their property. The User grants the Publisher a license strictly necessary to provide the Service.

12. Liability

The Publisher undertakes to provide the Service with diligence and according to industry best practice, under a best-efforts obligation.

The Publisher cannot be held liable for:

  • Service interruptions due to maintenance or force majeure;
  • Indirect damages, loss of business, loss of revenue or loss of data;
  • The content of messages sent by the User;
  • Actions by third parties (LinkedIn, prospects, integrations).

In any case, the Publisher's liability is limited to the amounts paid by the User during the last 12 months.

13. Personal data

The processing of personal data is governed by our Privacy Policy, which complies with the GDPR and the French Data Protection Act.

14. Updates to the Terms

The Publisher reserves the right to amend these Terms at any time. The User will be informed of any changes by email or via a notification in the Platform. Continued use of the Service after changes constitutes acceptance of the new Terms.

15. Disputes

These Terms are governed by French law. In the event of a dispute, the parties will seek an amicable solution. Failing that, French courts shall have sole jurisdiction.

Pursuant to article L.612-1 of the French Consumer Code, consumer Users may use a consumer mediator free of charge.
